Mass harm and collective redress: the role of litigation funding

Delex continues to contribute to the evolving conversation on collective redress at both international and national level.

Following our participation in the International Collective Redress Conference organised by the Bar Council of England and Wales and King’s College London — where leading judges, academics and practitioners discussed the latest developments in collective litigation and litigation funding — it was particularly valuable to attend the panels and exchange views with peers across jurisdictions, with a special mention to colleagues and friends Anthony Maton and Scott Campbell of Hausfeld, and Jeremy Marshall of Winward Litigation, for their insightful contributions.

We are pleased to see these themes further explored in the Italian debate.

Il Sole 24 Ore – NT + Diritto has published an article by Delex Managing Partners Giorgio Afferni and Lavinia Florimo, focusing on mass harm and the growing role of collective actions and litigation funding as essential tools to ensure effective access to justice.

The contribution highlights how structured, multidisciplinary teams and innovative funding models are becoming central to managing complex, large-scale disputes — a trend increasingly recognised also in Italy.

These parallel experiences reflect the accelerating momentum of collective redress frameworks.
